In 2009, with the passage of the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act, the federal government expanded the federal hate crimes statute to include crimes motivated by the victim’s actual or perceived gender, sexual orientation, or gender identity. However, some state hate crime statutes do not include gender, sexual orientation, or gender identity. Do you think this is a mistake? Are those states implicitly condoning violence based on these issues? Explain and support your response.
